Membership Agreement - Terms & Conditions (Last Modified on April 02, 2008)

Introduction
This membership agreement (the 'Agreement') is a contract between you (the 'User') and Public Service Institute Private Limited (the 'PSI') and this applies to your use of the PSI Services and any related products and services available through PSI website, http://www.psi.com.np (collectively the 'Service'). 'You' and 'Your' means any entity identified in the membership registration process, and/or any agency or network acting on its (or their) behalf.

Attention
You must read and agree with all the terms and conditions contained in this agreement before apply for the membership registration process. The PSI strongly recommend that you also access and read the information contained in the other pages, and affiliated websites, as they may contain further terms and conditions that may apply additional to you as PSI user. By accepting this agreement, you also agree that your use of PSI affiliated websites and services will be governed by the terms and conditions posted on those websites. If you do not agree to be bound by the terms and conditions of this agreement, please do not use the website further.

Membership
Membership in the http://www.psi.com.np is subject to PSI prior approval. PSI reserves the right to refuse any membership application in its sole discretion. By enrolling in the program, you represent that, you are not minors (age under 18); not suspended from our services and good knowledge of English language. Multiple membership accounts held by the same individual or entity are subject to immediate termination unless expressly authorized in writing by PSI.

Privacy
Unless approved by the user or ordered by the arbitration body of acceptable jurisdiction, as determined by the PSI, PSI shall not reveal user's general information- Name, Address, Phone, Fax, E-mail, and other similar information or other history to any third party. No employees and officers of the PSI will ever ask for user keyword. PSI committed to protect user's privacy.

Accuracy
The user must provide valid and accurate information and promptly update that information by login to homepage and choose 'Update Information' and the user may cancel their membership account at any time by login to homepage and choose 'Delete Your Account'.

Termination
PSI may terminate any user's membership account at any time with or without good cause and/or prior notice. Good causes may means but are not limited:

Impersonate or misrepresent of identity; or
Violation of any provision of this agreement; or
Aiding in or promoting circumvention of the PSI Service; or
Acting against the business interests or reputation of PSI; or
Acting in unlawful manner in relationship to PSI, its services or affiliate partner's; or
Strongly prohibited is 'abusive, annoying, slanderous or threatening correspondence of any kind'.

Publicity
The users understands and agree that PSI may use their general and other information in presentation, marketing materials, membership list, auditing, research and analysis and to provide the service you've requested.

Updates
PSI may update the membership agreement from time to time. It's your responsibility to check this document periodically, as there will be no individual notices to members regarding such updates. Your continued use of PSI websites constitute an affirmative acknowledgement by you of the membership agreement and any subsequent updates made to them and your agreement to abide and be bound by them.

Disclaimer
MEMBER EXPRESSLY AGREES THAT USE OF THE MEMBERSHIP PROGRAM IS AT YOUR SOLE RISK. THE MEMBERSHIP PROGRAM IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. PSI EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGMENT. PSI MAKES NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE MEMBERSHIP PROGRAM OR ANY TRANSACTION DONE THROUGH THE MEMBERSHIP PROGRAM.

Limitation
TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, NEITHER PSI NOR ANY OF ITS MEMBERS, SUBSIDIARIES, AFFILIATES, SERVICE PROVIDERS, LICENSORS, OFFICERS, DIRECTORS OR EMPLOYEE SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS MEMBERSHIP AGREEMENT, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF USER'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTENGIBLE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SITE IS PROVIDED TO YOU 'AS IS' WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
